Fydell House – standard terms & conditions
Please be aware that business with us is conducted on the basis of our standard terms and conditions which aim to protect all parties through a better understanding of the contractual obligations of both you and us when confirming a booking.
1.1 This document (together with the documents referred to in it) tells you the terms and conditions on which we hire our products or provide any wedding/function services.
1.2 Please read these terms and conditions carefully and make sure you understand them before requesting our services. You should print a copy of these terms and conditions for future reference. Upon booking with us, you will be deemed to have read and understood these terms and conditions and agree to be bound by them.
2. About Us:
2.1 We are Boston Preservation Trust Ltd, Fydell House, South Street, Boston, Lincolnshire, PE21 6HU. References to 'we', 'us' and 'our' shall be deemed to be references to us.
“Event” means the wedding, party or any other function at Fydell House.
References made to 'you' and 'your' being the person responsible for the commissioning of and payment for the Event.
3. How the Contract is Formed Between You and Us:
3.1 Please contact us as soon as you have a date in mind. We will keep a provisional booking for up to 2 weeks from the date of the provisional booking without obligation.
3.2 Confirmation. Bookings will be treated as provisional until the deposit and signed copy of Terms and Conditions are returned by you, which should be within 2 weeks of the provisional booking and we have confirmed our acceptance of the booking. If you do not confirm the booking within the 2 week period as set out above, we reserve the right to cancel the Event without notification to you.
The booking will detail the maximum number of guests permitted to attend the Event. It is your responsibility to contact us to confirm the final details of the Event which must be no less than 4 weeks before the date of the Event. The Green Room will seat up to 30 guests. The number of extra evening guests, if applicable, will need to be agreed at the time of the booking, and in any event must not exceed the maximum number of 30 for The Green Room.
For all Events other than a wedding a non-refundable deposit of 50% of the total estimated amount is required when making the booking. The outstanding amount due shall be paid at least 2 months before the Event date.
For a wedding a non-refundable deposit of £200 is to be paid when making your booking. 50% of the balance is due 6 months prior to the wedding date, with the final payment due 2 months before your Event date.
You should confirm to us the final number of guests attending not less than 2 weeks prior to the Event. Any additional amount payable will be calculated based on this final number of guests and must be paid prior to the Event.
Any variation in booking, guest numbers and/or arrangements must be confirmed to us in writing as soon as possible.
3.3 For a wedding we allow a two and a half hour hire use of the venue. An hour more will be £50, times to be agree before the event.3.4 Late or non-payment by you for Fydell House will be deemed to be a cancellation of the Event.
3.5 All prices quoted are subject to change for Events more than 12 months in advance. We will supply written confirmation of any change in our prices
3.6 Fydell House Green Room, the Library or the American Room will be available to you. The use of the kitchen will be £350 extra. Canapes may be served in the Entrance Hall.
One Day Event Hire
3.8 Fydell House Green Room or the American Room could be available to you from 10am to 10pm on the day of your event, times to be agreed.
4.1 Upon acceptance and confirmation of your booking with us, a legally binding contract exists. If you are forced to cancel your booking for any reason all payments and deposits made in accordance with clause 3 are non-refundable. Please notify us as soon as possible of any cancellation.
4.2 We reserve the right to cancel an Event under the following circumstances:
a) If the booking might, in our sole discretion, prejudice our reputation.
b) If you have not made a payment by the due date.
c) If Fydell House (if booked) or any part of it, is closed due to circumstances beyond our control. In this event a refund of any deposit and/or payment will be made, but we will have no further liability.
5. Provision of Services:
5.1 The services you have requested will be shown on your booking confirmation. When confirming your booking we will provide a completed form showing the services to be provided by us and the services or activities you will be arranging and costs incurred.
5.2 When providing information about your Event, you warrant that all the information provided is accurate. In the event that information is inaccurate, we reserve the right to amend the cost of the booking and/or cancel the booking as appropriate and in these circumstances we will not refund any deposit already paid.
5.3 Guests using our facilities must comply with all regulations concerning licensing, fire and health and safety.
5.4 Hazardous or dangerous items may not be brought into Fydell House. We reserve the right to approve of any externally arranged entertainment, services or activities that you arrange.
5.5 The use of Chinese Lanterns or Fireworks is not permitted.
5.6 Should guests act in an improper or disorderly way, or refuse to comply with reasonable requests from our staff, we reserve the right to immediately terminate your stay or Event. Should this occur no monies will be refunded to you. Our decision is final.
5.7 We will be liable to you and your guests for injury or loss and damage only where and to the extent we have been negligent, otherwise there shall be no liability whatsoever.
5.8 You will be held liable for any loss or damage to our property and fittings (including any items hired by us for your use), or for injury to anyone including our staff arising as a consequence of this booking. You shall indemnify us, our employees, contractors, agents and guests against any loss or liability (howsoever arising including any losses or breakages) incurred as a result of using a third party.
5.9 We strongly recommend that you take out adequate insurance to cover the cost of cancellation and other liabilities
5.10 We regret that we cannot be responsible for the security of your property or that of any third party or guest, and any property which they bring into Fydell House, however we will do our utmost to look after it. Our insurance does not include loss or damage to personal possessions belonging to you or your guests either within Fydell House or garden areas.
5.11 Wedding presents must be removed from the premises as we cannot accept these items for safe-keeping.
5.12 Please be aware that you will need to arrange your own appointment with the Registrar for Civil Wedding Ceremonies.
5.13 Food and alcohol cannot be placed or served prior to the Civil Ceremony due to legal reasons.
5.14 We operate a strict no-smoking policy throughout the whole of Fydell House and garden.
5.15 Only biodegradable confetti may be used.
6. The Use of Third Parties:
6.1 If you wish to bring in third parties, you may do so, however they must be approved by us before you confirm your booking with them. You are responsible for ensuring that any third party obtains adequate insurance to cover the cost of cancellation damage and other liabilities. Fydell House has limited kitchen facilities and depending upon catering requirements some wedding Events may require a catering marquee at extra cost.
6.2 We will not be responsible for, or liable for any part of any contract between you and any third party. You are fully responsible for the cost of any such services and you shall at all times be solely responsible for ensuring that all statutory obligations, licences and requirements are complied with by you and any third party. You may need a temporary events.
6.3 It is your responsibility to obtain and provide us with copies of all risk assessments and insurance for all activities conducted on site and all must be provided at least 4 weeks in advance of the Event including but not limited to their current public liability insurance, together with any insurance policies which we may reasonable request and any portable appliance testing reports proving the safety and suitability of bringing such equipment into Fydell House and garden in accordance with current health and safety standards.
6.4 You will ensure that any third party complies with our reasonable requests and comply with all the relevant health and safety legislation in force at the time. We reserve the right to deny access to any third party who has not or cannot produce the requested information and we will not be liable as a result of a subsequent cancellation by such third party.
6.5 Your own equipment and property, or that of any third party is brought in to Fydell House and garden at their own risk. We accept no liability for loss or damage. You must ensure that any marquees, tents gazebos etc are covered by your insurance. No bouncy castles,candles or Chinese lanterns. No dogs.
6.6 If you do bring in your own caterers you will be solely responsible for them during the time they are on the premises and you will ensure that any outside caterers will:
a) provide us with a copy of their current public liability insurance at least 1 month prior to the Event.
b) provide us, or to the local authority if so requested, any insurance policies which we may reasonably request including portable appliance testing.
c) comply with all relevant health and safety legislation in force at the time.
d) comply with our reasonable requests during the event.
6.7 You shall indemnify us, our employees, contractors, agents and guests against any loss or liability (howsoever arising including any losses or breakages) incurred as a result of using an outside company.
6.8 You shall ensure that if an outside caterer is used then the kitchen and any facilities used by them shall be left in a clean and tidy state and you shall be liable for all cleaning costs if any additional cleaning is required.
7. Licence and Bar Regulations: The sale of alcohol is strictly forbidden. You must ensure that all persons attending the event comply with all requirements of the Licensing Act. These terms and conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
By signing this you agree that you have read and accepted the above information and terms and conditions sections of this contract and you agree to be bound by them. You agree that you will notify all attending guests and third parties of the above information and terms and conditions and their obligations thereunder. You will be responsible for all breaches of these terms and conditions by any guest or third party in attendance at the Event.
